Terms of Service

Welcome to RoastrAI (the "Service"). These Terms of Service ("Terms") govern your access to and use of the Service operated by RoastrAI ("we", "us", or "our"). By using the Service you accept and agree to these Terms. If you do not agree, do not use the Service.

1. Definitions

• Account: the account you create to use the Service.
• User Content: text, images or other material you upload or submit to the Service.
• Generated Content: content produced by RoastrAI based on prompts or inputs you provide.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have consent from a parent or guardian to use paid features.

3. Accounts & Registration

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate information and to keep your account information up to date.
• We reserve the right to suspend or terminate accounts for violations of these Terms or misuse of the Service.

4. Acceptable Use

RoastrAI is designed to produce humorous and edgy content. However, you must not use the Service to produce or distribute content that:

• Is unlawful, fraudulent, or promotes illegal activity;
• Incites violence, hatred, or discrimination against a protected group;
• Is sexually explicit involving minors or non-consenting adults;
• Infringes third-party intellectual property or privacy rights;
• Contains doxxing, stalking, or targeted harassment.

We may moderate, remove, or refuse to publish User Content or Generated Content that violates these rules. Repeat or severe violations may result in account termination.

5. User Content & Licenses

You retain ownership of the User Content you submit. By submitting User Content, you grant RoastrAI a worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, modify, distribute, and display that content to provide the Service (including training/quality-improvement processes). You represent and warrant that you have all rights necessary to grant this license.

6. Generated Content

Generated Content is produced by the Service based on your inputs. You are responsible for how you use Generated Content. We do not guarantee that Generated Content is accurate, lawful, or free from third-party rights. You should review and, if necessary, edit Generated Content before sharing or publishing it.

7. Payments, Billing & Refunds

• Paid features are billed according to the plan you select on the Pricing page.
• Payments are processed by our third-party payment processor. You agree to their terms when you complete a purchase.
• Unless otherwise required by law or explicitly stated in a plan, payments are non-refundable.

8. Third-Party Services

We integrate and rely on third-party services (for example, Supabase, OpenAI, payment processors). Use of those services is governed by their terms and privacy policies. We are not responsible for third-party performance, availability, or policies.

9. Intellectual Property

The Service and all original software, designs, text (excluding User Content), graphics and other materials that we make available remain our property and are protected by copyright, trademark and other laws.

10. DMCA & Copyright Policy

If you believe your copyrighted work has been used in a way that constitutes infringement, please notify us with a DMCA takedown notice at the email below. We will respond and process valid notices in compliance with applicable law.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROASTRAI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE LAST 12 MONTHS (OR $50 IF YOU PAID NOTHING).

13. Indemnification

You agree to indemnify and hold RoastrAI and its officers, employees and agents harmless from any claim, demand, loss, or damages, arising from your breach of these Terms or your violation of law.

14. Termination

We may suspend or terminate your access to the Service for violations of these Terms or for any other reason with or without notice. Sections that by their nature survive termination will continue to apply.

15. Changes to Terms

We may modify these Terms from time to time. If changes are material, we will provide notice (by email or within the Service). Continued use after changes constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the jurisdiction where RoastrAI is incorporated, without regard to conflicts of law rules. Any dispute will be resolved in the courts located in that jurisdiction, unless we agree otherwise in writing.
